VENDOR RULES AND REGULATIONS
Fee Schedule/Cancellation
Vendor fee is non-refundable and non-transferable unless written notice of cancellation is received 15 days prior to event. Vendor Fee must be submitted with application no later than July 31, 2010.
Food/Beverage vendors must provide their Fulton County Department of Health Permit no later than July 31, 2010.
Vendor Setup/Breakdown
All vendors are required to comply with vendor setup schedule. If vending at an event only, vendor exhibit must be set up no later than 1 hour prior to event start time of event. Vendors will not be permitted to setup after event begins. No exceptions.
All vendor supplies/equipment must be broken down immediately following the event.
Acceptance/Agreement:
Upon acceptance, vendor agrees to abide by all rules set forth by Traxx Atlanta, Inc. and to honor instructions as deemed necessary during the event as issued by either the Festival Chairman and/or designee.
Unforeseen Events:
Traxx Atlanta, Inc. cannot guarantee vendor’s protection from loss or insure against loss for any reason. Vendor hereby waives any claim for incidental or consequential damages or compensation resulting from the inability to use the premises and agrees that Xtreme Entertainment, Inc. may retain the portion of payments made by Vendor necessary to cover expenses incurred by Traxx Atlanta, Inc. incidental to the opening and management of the event through the time of termination.
Booth Coverage:
Vendor shall be responsible for providing his/her own staff. Vendor exhibits shall not be left unattended until after the publicized closing hour.
Waiver of Liability:
It is specifically agreed by the parties of this agreement that Traxx Atlanta, its agents, employees or assignees are in no way liable for any loss, damages or theft of any property belonging to the Vendor while on the site, grounds and area of the event. The vendor specifically acknowledges that Traxx Atlanta does not provide any insurance and accepts no responsibility for any such loss whether the said loss is by accident, act of God, intentional act of destruction or theft.
This agreement is based upon the personal relationship between the parties. Vendor shall not have the right to assign, share or sublet this agreement or any interest in this agreement, and this agreement shall not be assignable by operation of law without the consent of Traxx Atlanta, Inc.
The undersigned has read and agrees to all the terms set forth above, as well as the terms of any attached addenda. |
